1. Introduction

Welcome to IoTech Solutions (the "Site"). The Site is owned and operated by IoTech Solutions (PTY) Ltd (Registration Number: 2025/599244/07) ("we," "us," "our").

These Terms and Conditions govern your use of our Site and the purchase of products from us. By accessing, browsing, or making a purchase from this Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions and our Privacy Policy.

If you do not agree with any part of these Terms, you must not use our Site or purchase our products.

2. Products and Services

We make every effort to display our products as accurately as possible. However, we cannot guarantee that your device's display of any colour or the detailed specifications will be accurate. All products are subject to availability. We reserve the right to discontinue any product at any time.

3. Orders and Payment

  • Placing an Order: By placing an order through our Site, you make an offer to purchase the selected product(s) subject to these Terms. We reserve the right to accept or decline your order for any reason, including but not limited to the unavailability of stock, pricing errors, or concerns about fraudulent activity.

  • Pricing: All prices are listed in South African Rand (ZAR) and exclude Value-Added Tax (VAT) where applicable. We reserve the right to change prices at any time without prior notice. The price charged will be the price in effect at the time your order is placed.

  • Payment: Payment must be made in full before an order is dispatched. We accept payment via Credit Card, EFT and PayPal.

4. Shipping and Delivery

Delivery times provided are estimates only and are not guaranteed. We are not liable for any delays in delivery caused by third-party courier services or events beyond our reasonable control (force majeure). Risk in the products passes to you upon our delivery to the courier service.

5. Returns, Refunds, and Warranties

5.1 Warranty

All products sold by us are covered by a warranty provided directly by the manufacturer. The warranty period is for 12 months from the date of invoice. Warranty claims are subject to the specific terms and conditions set by the manufacturer. We will facilitate the warranty process by acting as a liaison between you and the manufacturer, but the final determination and fulfilment of any warranty claim are the responsibility of the manufacturer.

5.2 Returns and Refunds

We hope you love your purchase, but if you are not completely satisfied, you may return eligible items for a refund under the following conditions:

  • Eligibility Period: You have 30 (thirty) calendar days from the date of your invoice to initiate a return.

  • Condition of Item: The item must be returned in its original, saleable condition, unused, and with all original packaging, tags, and accessories included.

  • Return Process: To initiate a return, please contact our customer service team at info@iotech-solutions.co.za to obtain a Return Merchandise Authorization (RMA) number. Returns will not be accepted without a valid RMA number.

  • Handling Fee: A 20% (twenty percent) handling and restocking fee will be charged on the value of the returned product. The refund amount will be the purchase price minus the handling fee.

  • Refund Processing: Once we receive and inspect the returned item, we will process your refund to the original method of payment within 7-10 business days. The cost of return shipping is the responsibility of the customer, unless the return is due to a fault on our part (e.g., incorrect item shipped).

Please note that this returns policy does not affect your statutory rights under the South African Consumer Protection Act, 2008 ("CPA").

6. Limitation of Liability

To the fullest extent permitted by law, IoTech Solutions (PTY) Ltd, its directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or in any way connected with your use of the Site or the products purchased, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to these Terms or the products, whether in contract, tort (including negligence), or otherwise, shall not exceed the total amount you paid to us for the product(s) from which the claim arose.

7. Intellectual Property

All content on this Site, including but not limited to text, graphics, logos, images, and software, is the property of IoTech Solutions (PTY) Ltd or its content suppliers and is protected by South African and international copyright and intellectual property laws.

8. Governing Law and Jurisdiction

These Terms and Conditions and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the Republic of South Africa.

You hereby consent to the exclusive jurisdiction of the South African courts in respect of any disputes arising in connection with the Site, or these Terms and Conditions.

9. Changes to Terms and Conditions

We reserve the right to update, change, or replace any part of these Terms and Conditions by posting updates and changes to our Site. It is your responsibility to check our Site periodically for changes. Your continued use of or access to the Site following the posting of any changes constitutes acceptance of those changes.
